Trade business

GmbH with eight employees

In a trade GmbH with eight employees, a dismissed employee files a claim at the labour court. The employment module pays your lawyer. Without it you pay your own lawyer in the first instance even if you win, which is why most employers start with this module.

Café owner

Sole trader after a tax audit

A café owner trading as a sole proprietor receives an amended assessment from the Finanzamt after an audit. If the case reaches the Finanzgericht and your tariff includes the tax court module, that module pays the proceedings. An accusation of negligent tax understatement (§ 378 AO, an administrative offence) falls under the administrative offence module; alleged intentional tax evasion (§ 370 AO) is not covered under the model terms.

Freelancer

IT consultant without staff

A client of an IT consultant without staff does not pay the final invoice. Contract cover finances the claim if your tariff includes that module; the German model terms leave it out of the business package. The social court module matters when the health insurer disputes your self-employed status.

How Much Does It Cost in 2026?

What moves the premium

  • Sector: a craft business with site work is rated differently from a consultancy working from a desk.
  • Headcount and turnover: more staff means more potential employment disputes.
  • Modules: each building block you add (employment, contract, criminal defence, tax court, traffic) adds to the price.
  • Deductible: the higher your own share per case, the lower the premium.
  • Sum insured: the cap the insurer pays per case. A higher cap costs more.

Do You Actually Need It?

Business legal protection is not mandatory in Germany. Before the labour court you pay your own lawyer in the first instance even if you win (§ 12a ArbGG); in a civil claim you advance the court fee and your lawyer fees and recover them only if you win.

You should seriously consider it if you:

  • Have employees (employment disputes are the most common trigger)
  • Sign contracts with clients or suppliers regularly
  • Deal with German tax authorities (Finanzamt)
  • Operate in a regulated industry

Under the German model terms, most modules do not cover events that occur in the first three months after the policy begins. You cannot buy insurance after a dispute starts and expect coverage. Plan ahead.
