What is Grundbesitzerhaftpflicht?
In Germany, property owners have a legal duty to keep their land and buildings safe. This is called Verkehrssicherungspflicht (duty of care), based on BGB section 836. If someone gets hurt because of your property, you are liable.
Your regular personal liability insurance (German: Privathaftpflichtversicherung) only covers your own home, the one you live in yourself. The moment you rent out a flat, own an empty lot, or manage a building with multiple units, you need a separate Grundbesitzerhaftpflicht policy.
This insurance covers:
- Personal injury (someone falls on your property)
- Property damage (a tree from your land damages a neighbor's car)
- Financial losses resulting from those injuries or damages
One thing to keep in mind: Grundbesitzerhaftpflicht is not the same as building insurance (German: Wohngebaeudeversicherung). Building insurance covers damage to the building itself, like fire or storms. Property owner liability covers damage your property causes to other people. Many landlords need both. Who needs property owner liability insurance?
Landlords
Renting out a house or apartment? You are personally liable for injuries on your property. If a tenant or visitor gets hurt because of poor maintenance, you pay.
Empty land owners

Homeowner associations should have a joint policy for shared property like staircases, parking areas, and communal gardens.
Holiday rental owners

What does Grundbesitzerhaftpflicht cost?
Premiums depend on the property type, its location, and the number of units. For a single-family house, policies start around EUR50 per year. Multi-unit buildings cost more depending on the number of apartments.

What does property owner liability insurance cover in Germany?

Is Grundbesitzerhaftpflicht mandatory for landlords?
There is no legal requirement to have this insurance. But as a landlord, you are personally liable for damages on your property under German law. Without insurance, you pay claims from your own savings. Most property advisors consider it a must-have for landlords.
How much coverage do I need?
